What Does an Executor Do in Ontario?
When someone passes away, there is more than grief to navigate — there are legal, financial, and practical steps that must be handled carefully. The executor (also called an Estate Trustee) is responsible for managing this process from start to finish.
Below is a simple step-by-step overview of what an executor typically does in Ontario — and where having the right guidance can reduce stress, prevent delays, and protect you from personal liability.
Secure Assets
Protect the estate right away so nothing is lost, damaged, or accessed improperly.
- Secure the home, valuables, and vehicles
- Locate the Will and key financial documents
- Notify banks and safeguard accounts
Arrange the Funeral
Carry out the deceased’s wishes and coordinate practical arrangements during an emotional time.
- Review funeral instructions (if any)
- Coordinate with the funeral home
- Pay funeral expenses from estate funds when available
Apply for Probate (When Required)
Many estates require a court certificate to confirm the executor’s legal authority.
- Prepare the probate application
- Value assets and calculate Estate Administration Tax
- File documents with the Ontario court
Notify Beneficiaries
Executors have a duty to communicate clearly and keep beneficiaries reasonably informed.
- Notify beneficiaries named in the Will
- Provide updates on timing and next steps
- Maintain transparency to reduce conflict
Pay Debts and Taxes
Before anyone receives an inheritance, the estate’s obligations must be handled properly.
- Pay outstanding bills and liabilities
- File tax returns and pay taxes owed
- Obtain a CRA clearance certificate when appropriate
Distribute the Estate
Once debts and taxes are resolved, the remaining assets can be distributed according to the Will.
- Prepare estate accounting and receipts/releases
- Transfer funds and property to beneficiaries
- Close the estate file and finalize records
