What is a holographic will?

A holographic will is a handwritten will made and signed by you, without witnesses. It must be written entirely in your own handwriting and signed at the end.

Is a holographic will legal in Ontario?

Yes. Under Ontario’s Succession Law Reform Act, handwritten wills are recognized — as long as they are fully handwritten and signed by the testator.

When should someone use a holographic will?

A holographic will is best used only in emergency situations, such as:

  • Unexpected illness or hospitalization
  • Traveling without access to legal services
  • Urgent circumstances where a lawyer cannot be reached

For long-term planning, a properly drafted will by an estate lawyer is strongly recommended.

Do I need witnesses?

No. Unlike a traditional will, no witnesses are required for a holographic will in Ontario.

What makes a holographic will valid?

To be valid, the will must:

✔ Be entirely handwritten by you
✔ Clearly express your intentions
✔ Be signed at the end
✔ Be made voluntarily
✔ Be made while you have mental capacity

Typed or partially-typed documents are not valid holographic wills.

What should I include in a handwritten will?

At minimum, include:

  • A statement that it is your will
  • Your full name and address
  • Revocation of prior wills
  • Appointment of an executor
  • How you want your assets distributed
  • Your signature and date

What are the risks of a holographic will?

Holographic wills often lead to:

⚠️ Ambiguity in wording
⚠️ Disputes among family
⚠️ Court challenges about capacity or influence
⚠️ Missing key legal protections
⚠️ Delays and higher probate/administration costs

Many estates with handwritten wills end up in court due to unclear language.

Can I update my holographic will later?

Yes — but again, changes should be:

  • Fully handwritten
  • Signed and dated

For anything beyond a minor emergency change, a lawyer-drafted codicil or new will is far safer.

Where should I store a handwritten will?

Keep it in a safe and accessible place, and tell your executor where it is. If it’s lost or damaged, your wishes may not be followed.

Should I rely on a holographic will long-term?

No. A holographic will is a temporary solution, not a replacement for professional estate planning. Mistakes in handwritten wills can cost families more in court fees than the cost of a proper will.
