In Ontario, a holographic will is a handwritten will made entirely by the testator (the person making the will), signed by them, and not witnessed. It is legally valid under s. 6(2) of the Succession Law Reform Act (SLRA).
Requirements for a Valid Holographic Will in Ontario
To be legally valid:
- Entirely handwritten by the testator
- Typed, printed, or partially-typed holographic wills are not valid.
- Signed by the testator at the end
- Signature must show final intention.
- Testator must have capacity
- Sound mind, over 18 (or married/previously married).
- Made voluntarily — no undue influence.
No witnesses required
Unlike a formal will, holographic wills do not need two witnesses.
How to Make a Holographic Will:
- Write the will entirely in your own handwriting.
- State that it’s your will: “This is my last will and testament.”
- Identify yourself with full name and address
- Revoke previous wills
- Appoint an executor
- Clearly state how you want your assets divided
- Sign and date at the end
- Store it safely and tell someone where it is
